Private Servers

A Conversation a friend and I just had on a messenger service:

Him: BTW I'm setting up a private wow server if I can get it running ok
Me: that's illegal
Him: no it's not...I checked into it...it uses an emulator...it's perfectly leagle.
Him: using the database content from blizzard is the illegal part.
Him: it's jsut to mess around with and try other classes w/o grinding them up.
Him: I'm not leavign wow or anythig LOL
Me: seriously it's illegal ... go ask on the forums.
Him: seriously it's not... I've done alot of research...the illegal part is using the content from blizzard...which I'm not.
Me: so it's totally not Azeroth in anyways without any bosses or mobs or NEs?
Him: it's an emulator...not an actual wow server
Him: it's hard to explain...

So, who's right?

Wait, so...."it's totally not Azeroth in anyways without any bosses or mobs or NEs, your friend wants to play a different game, with other mods that takes place in another land", but your friend wants to pretend its wow, Ciciana? I mean, I can send you guys cut out paper characters, and "monsters", so your buddy can test out new classes if they’d like? :0P


As far as the “official” stance of Private Servers goes, I would have your friend look at the End User License Agreement and Terms of Use (http://www.worldofwarcraft.com/legal/) for the following sections, as Sonic has pointed out.

Both have a section that covers Ownership, such as Section three subsection (A) of the EULA:

A. All title, ownership rights and intellectual property rights in and to the Game and all copies thereof (including without limitation any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, character inventories, structural or landscape designs, animations, sounds, musical compositions and recordings, audio-visual effects, storylines, character likenesses, methods of operation, moral rights, and any related documentation) are owned or licensed by Blizzard. The Game is protected by the copyright laws of the United States, international treaties and conventions, and other laws. The Game may contain materials licensed by third parties,


The EULA continues on and states in Section four subsection (B) that:

You agree that you shall not, under any circumstances,

(iii) host, provide or develop matchmaking services for the Game or intercept, emulate or redirect the communication protocols used by Blizzard in any way, including without limitation through protocol emulation, tunneling, packet sniffing, modifying or adding components to the Game, use of a utility program or any other techniques now known or hereafter developed, for any purpose, including without limitation unauthorized network play over the Internet, network play utilizing commercial or non-commercial gaming networks, or as part of content aggregation networks;
