banned and the 12 month sub commitment

I just recently canceled my sub because im sick of my $15/month going to improve pve instead of bettering pvp play, caught in the moment i came back for the 12 month sub lock in to get diablo free and what not, after coming back and not seeing any improvment in the game pvp wise and the silence of blizzard in the pvp forums just refusing to address or even comment on the current state of pvp i wish to cancel my sub again, but i guess im locked in so im wondering if i like buy gold ro do something to get banned am i still responsible for paying for 12 months subscription?

Actually, you are quoting a post made on the EU forums. Different laws apply in different regions. :)

It is true that if your account is closed, you'd be unable to fulfill the 12 month commitment that you agreed to. All associated benefits from the promotion would be removed. While that is the most likely outcome, the Terms of Agreement does leave room for further recourse, if necessary.
