Assuming this question is hypothetical, Trokish, there are a couple of things to go over.
If the Battle.net account is in the name of the ex then this person would need to contact us and explain the situation. Keep in mind though that this would sound an awful lot like this person would like to give away the account, which is something that is not supported.
On the other hand, if the World of Warcraft license that was merged into the Battle.net account was originally registered to the non-ex, there is a slight chance an exception could be made in transferring the account to another Battle.net account. More than likely CD keys would be needed for verification purposes, so the non-ex would want to locate these codes prior to calling.
Ultimately, contacting Account Services to discuss the situation in greater detail would be the best option for both parties.
