GM's disbanding inactive guilds

While looking at options to xfer my entire guild to another server it came to our attention that a guild with the same name exists. Renaming would work but really a bad option and a last resort.

The guild itself has only 1 member, who has been inactive since before the 3.0 patch, since they have zero achievement points a level 43. Which would mean they haven't even logged in to get their "Level 10/20/30/40" Achievements since the system was implemented.

What possible reason could there be for a GM to deny the disbanding of a guild that is clearly inactive to make way for a large group (30+) that are paying to xfer there.

However, this might now be a 'bank guild', which means there is possibly a level 1-9 operating as a bank for someone else. Hence why its not on armory.

I have a bank alt that has his own guild; he is level 2 and has four of six of the tabs purchased. I have put a lot of effort (and gold) into all that the guild has and I can tell you honestly that I would be extremely upset if my guild was simply disbanded because someone else wanted my guild name.
