X-53 Air only or land also?

Since the 4.0 patch I have seen a lot of X-53 2 seat flying mounts all over Kalimdor and the Eastern Kingdoms. Are these considered a land mount now? I remember seeing a blue poster saying they wanted names of people using flying mounts where they should not be usable, does the X-53 fall into this catagory of exploit or are they ok?

If you see ANYONE 'flying' in the old world at this point, feel free to submit their names.
