Transferring characters across accounts

Well, I've got a small predicament. This is my main account with a 70, 63, and various characters 20+. Well I aquired a friends account a while ago (March 07) when he quit the game (I didn't hack it or anything like that, it's still got the original email/information and I can ask him to log on it if needed, or even a scan of the guys liscense lol) and it doesn't have TBC on it. Anyway, I'd like to transfer a character over from that account to save money of having to pay 2x the accounts and rebuy TBC. I was looking into transfering between accounts and I found http://us.blizzard.com/support/article.xml?articleId=20558 as the page to go to really.

Anyway, my question was about the Account Restrictions on that page. It says
Q u o t e:
Transfers between accounts can be done only if you are the subscriber on both accounts.

Does this mean the contact information must be the same (I created both accounts) or just that the payment is done by the same person (X created the account I want to transfer from, I created the second)?

Assuming its the second part and I can transfer the character over, do I need to be the current subscriber (both accounts are active) or does the CC info have to be the same on both, even though it isn't active.

And finally, when you go to the Paid Char Transfer page and start the process it says
Q u o t e:
WARNING: You may only request character transfers from one account where you are the subscriber to another account where you are the subscriber. Any attempt to transfer a character from an account where you are not the subscriber could be considered a violation of the World of Warcraft Terms of Use and could lead to Blizzard taking disciplinary action against your account, including, but not limited to warnings, temporary account suspension, or permanent account suspension, as determined by Blizzard.

How would I go about making it so that Blizzard wouldn't assume that since the accounts aren't originally from the same people, Blizzard won't just ban/suspend them accidentally.

Thanks for any help.

I'm sorry, Stutters, but your friend is not allowed to give, trade or sell his account to anyone. Only the registered user and one minor child (that the registered user is the parent or legal guardian of) may access the account.

You can not transfer a character from that account to yours, you should not be accessing his account at all.

If that account was suspended or closed I don't believe it would be an accident, Stutters, since you are violating the Terms of Use.

It would be a very good idea for you to contact your friend and tell him to reset his password.
