My Main Character's Guild

I recently returned to WoW after an absence of several months (I have yet to add a game card to my 10-day trial, but payday has yet to pass). Upon my return several things were different with my character where apparently a gold seller had taken over my account a while back (that issue was resolved at the time, after all I wanted to be able to return to my character eventually). I'm not missing any gear or anything like that, however I am in a guild, and apparently the guild consists of myself and one level one member whos last login was the same time that the gold seller was kicked from my account (I should also note that I now have an authenticator attached). I have the ability to add members, but not to kick members, I also have the ability to access the guild vault.

My point is that a few of my friends and myself are wanting to start our own guild, and I was wondering if there would be any way to take over the guild I am apparently a part of instead of having to start an entirely new guild. If there is any way to take over as guild master I would like to do so. However, if this is impossible or goes against a blizz policy that I clearly don't know about, I understand. I just thought this would be simpler (and a little cheaper) than going through the process of starting up an entirely new guild.

Also I should note the guild I am referring to is the one my main charcter, Swarzsinne, is attached to.

If this is something that can't be done I'll just leave the guild this character is in and start a new guild. Thank you for your time.

If you are referring to your 60 DK on Akama, I'd not use that guild.

Not only because of it's history and possible ties, but because the name could easily be reported and have repercussions of it's own.
