If you can, Fonic, forward the following information to your brother in law. This should help him get control over the account.

May I also suggest you edit your in game ticket and include the name of at least one of the characters on his account. Unfortunately, "Account hack..." won't give our game masters enough information, should you go offline.

Got hacked? Let us help. - https://us.battle.net/account/support/account-recovery.html
  • First, make sure you secure your computer. You will need to run multiple virus scans and if possible use more than one scanner.
    Secure Your Computer: http://us.blizzard.com/support/article/30805

  • You will then want to change the password to your personal e-mail. Make sure you do not use the same password as your previous e-mail or battle.net account. If possible, use another computer to make these changes.
    Secure Your Email Address:http://us.blizzard.com/support/article/30806

  • If you were able to successfully full out the recovery webform an in game ticket will be automatically created and our game masters will investigate the account for any missing items. Feel free to open an in game ticket if you have any additional questions regarding item restoration.
  • Contact In-Game Support to Report Any Character, Item, or Currency Losses:http://us.blizzard.com/support/article/30807
It is important that you continue checking your system for additional malware to prevent future compromises.

In addition to computer security, you may wish to look into obtaining a Blizzard authenticator for your account.

Q u o t e:
Actually, it sped up the process. 2 minutes after posting in here, my in game ticket was escalated. so it did help the process. locking an account sooner rather than later will also help them with the recovery process. less items to recover = faster recovery time, and easy for them to deal with. : /
Just to clarify. Our escalated queue is much lower than it has been in the past, Fonic.

From our last twitter update: Tickets that have been escalated: +0d:1h:0m

As Moon mentioned, posting does not actually speed up the process nor does it grant you or anyone immediate assistance.

I am however, very glad our game masters were able to contact you in a timely manner. Don't forget to pass along the information as it will help prevent future compromises. Best of luck!
