Losing character due to smart hacker

So let me first start of by stating I am very angry on this whole situation that I have been wasting my personal time dealing with for 2 months now. I had this battle.net account hacked a couple months ago and on one of the accounts a rogue was transferred off onto another account that was made in my name (I DID NOT MAKE THAT ACCOUNT) so for the last couple months on calling support, sending emails and speaking with in game GMs I am getting NO help getting this fixed. Basically to sum it up the admins have told me tough luck you lost your character. Here is the email copy n pasted:

So basically thats stating that if someone hacks me and gets enough information to call in to support repeatedly and support aids them in getting access to the account that IF THEY REALLY want a character they just need to make a new account and transfer the character to it. I mean really i have explained SEVERAL times that I didnt make that account and I didnt authorize a transfer of my character to it. So how can they say they cant verify the reported abuse........ IVE EXPLAINED THE ABUSE.

So can someone please explain to me why do I get nothing in return if Im being told tough luck?? I put many hours into a character, just like any of you out there have on your characters. How would you feel if blizzard support team who strives to provide the best support possible does not help you or listens to you??

Keep in mind that per our TOS:

You are responsible for maintaining the confidentiality of the Login Information, and you will be responsible for all uses of the Login Information, whether or not authorized by you.
