Loot Distribution question

I am aware of the loot / scamming policies. Just wanted to get others opinion on the situation that I witnessed.

Story

Instance ICC 10

Loot rules were MS>OS (Set before the pull of the first boss)

After heroic Loot ship one handed axe drops . Raid leader links the axe and says roll, Him and another DPS roll. The raid leader loses the roll, and argues that other DPS should have told him before hand and loots the axe to himself. Both DPS had Two handed weapons at the time of the roll.

DPS classes that rolled were a Hunter and a DK.

Both were DPS , so it wasn't like a tank rolling on it or a healer.

To me and perhaps I miss understand the loot policy/Scam that this would fall under a scam.
Because both Rolled Validating the MS>OS rules, but it became a scam only after the raid leader lost the roll and looted it to himself.

To be clear, Cordus, MS>OS is not a loot rule that our In-Game Support department is able to support. It doesn't matter what your main or off spec is, it doesn't matter what you were using at the time of the run or what roll you played or how much damage/healing you did or did not do.

What matters is what items would be rolling on and how a winner is determined.

If you believe a scam took place based off of the Master Looters actions you are welcome to report it via an in-game petition and your claim will be looked into. It is important to note that we will look into a possible scam only, it is unlikely that we will redistribute any items/gold that may have been otherwise received.
