Lost character

I recently recovered my account from a hacker. When I logged on for the first time in ages... the only things missing from my account were my money and an undead lvl 30 rogue named Undeadned. While I was on the phone with the rep recovering my account, I had him check on the status of my characters. He could find no record of Undeadned. After I submitted a ticket, I settled in to wait for my gold. I then recieved an in-game mail that spoke of the goal of the restoration process was to get all players playable again... in addition, I recieved about 1k to "start over." This was about how much I lost, so I'm not peeved at that. What I am angry about is that the note did not adress my missing character issue. In other words, they failed their so called goal.
Low and behold I log onto the forums to complain... and which toon does it select for me to post as? UNDEADNED! The only thing that confuses me is the lvl, I am fairly certain that I lvled this character past the lvl that it includes with the picture. Obviously, there IS a record of my missing character. The blizzard rep I spoke to did not look hard enough. Im going to try an in game ticket tonight, but hopefully I can get a blue to respond to this post before then.

Heya Undeadned,

I apologize for any frustration regarding your missing character and the GM encounter, I will investigate further for you. Is this the account that your rogue was on? Was the rogue on Stormreaver?

Thank you for your response, I was able to look into this and did see that the character no longer exists, and probably because of the following:
Q u o t e:
When I logged on for the first time in ages...

If I stop playing and cancel my account, will my characters be deleted?
    http://us.blizzard.com/support/article/19324

Please note, however, that deleted characters on an account will be permanently removed from our databases and become unrecoverable after a certain length of time, depending on their level:

    1-30: Deleted after two months.
    31-49: Deleted after four months.
    50 and above: Never deleted.

Q u o t e:
The hacker was in possession of my account for an extended period of time. He/she is the one that did the deleting. Are you telling me that my character is forever lost? If so, then I find that ridiculous. That would mean that there is a loophole that allows a character to be stolen and unrecoverable. I find this to be a serious breach in blizzard's customer service. There IS a record of my character, proven by the fact that I can post as HIM on the forums. Therefore, its reasonable to assume that there should be a way to recover my character.
The character was not deleted by the hacker, it was deleted by the system due to its level, as the article states.
