Need help from a Blue with a ridiculous mess

Last Tuesday my friend and I ran an ICC 25. I was leader on my main (80 warrior on this account). He was assist on his 80 warrior. Our plan was to take Deathbringer's Will if it dropped. We knew that we were going to take this trinket as we were making the raid so we didn't make any loot rules other than Master Looter.

The trinket dropped and I didn't let the raid roll on it, I just took it. I "ninja'd" it if you will. So when my friend and I get back to Dalaran with the trinket in my possession, I say in ventrilo, lets roll for it. Nothing was said in game just to be clear. We roll, he wins. I trade him the trinket. After I lost I offered him gold and items for the trinket. He accepts. I traded him 8.4k gold, two primordial saronites and 12 dreadstones. He puts Deathbringer's Will into the trade window and we trade. I have the trinket and he's got my gold.

Sunday I was banned. The email I received said it was a 24 hour suspension for "trade scamming":

Greetings,

Account Name: <removed>
Realm: Frostmane
Character Name: *****

Account Action: 24 Hour Suspension

Be aware that additional inappropriate actions may result in further disciplinary action, leading up to or including Account Closure.

Offense: Scamming another Player
This category includes:
Acquiring items or any other "possessions" from another player through misinformation, confusion, or fraud (Scamming)

Details: Character above had made a trade agreement with another character and did not honor the terms of the agreement.

----------------------------------

Not only did that say I trade scammed someone (which I clearly didn't) and made no mention of an item removal from my account or gold restoration but it said I was suspended for 24 hours and when I logged into account management it said my ban was over:

Expires: Tuesday, 25 May 2010, 02:08, UTC

So I make a post about the ban time here:

http://forums.worldofwarcraft.com/thread.html?topicId=25026574213&postId=250242722765&sid=1#3

and the GM moved my ban time expiration up to about a half hour ago now. So I'm unbanned. I log into the game and see that not only have they taken Deathbringer's Will from my character and inventory, the gold I gave my friend is not returned. Why is the gold significant? Because on Sunday the GMs removed 13kg and told him it was returned to the owner.

I am livid. I've had items ninja'd from me several times and I've made tickets where the GMs respond saying there is nothing they can do about it. So the one time I take an item in which Master Looter was turned on I get this total and complete mess. I need some clarification from Blizzard here. This is unacceptable to me. I have been a customer for 5 years as long as anyone else and this is the only time I feel that I've been wronged. Where's my trinket? Where's my gold?

Also, I will not be responding to you if you plan on insulting me. I'm trying to get actual help here from a Blue.

After reviewing this case, a member of our Game Master staff was able to verify that looting rules were clearly established and then broken, Darkphoenìx. This is considered a scam. If you disagree with the actions taken, only our Account Administration department will be able to investigate further and overturn the penalties (including gold and item removal).

Given the circumstances surrounding the trade you made with your friend, I definitely encourage you to clearly explain the trade agreement to our Account Administration department to ensure that they are aware of all of the details. Please be aware, however, that the account actions were taken in regards to the looting scam and were not related to the actual trade agreement.

I appreciate your patience and encourage you to e-mail [email protected] at your earliest convenience.

Q u o t e:
Master looter was our only rule of the raid.

This is not correct. You may not recall exactly what you stated, but it is evident that loot rules were clearly defined in chat. The trinket in question was removed as a result of this account action and will, therefore, be ineligible for restoration unless the account action has been overturned. Once again, only our Account Administration department will be able to investigate this further.

I sincerely apologize if you feel that I have provided you with insufficient assistance, Darkphoenìx, but I can assure you that everything I am saying is entirely true. When asked about the loot rules, you clearly replied with, "MS over OS free rolls" and said "nothing" was on reserve. Given the fact that these rules were clearly established in raid chat, we treated this as a scam and took all necessary actions which included removing the item that was gained illegitimately.

Also, please be aware that Syndri mentioned the following within her post:

You're still welcome to submit a petition and have our In-Game Support staff investigate. Perhaps additional rules were shared that you're not remembering right now, for example. Either way, we'll be happy to look into the matter further and assist if possible.

The only recourse for this particular action is to contact our Account Administration department via e-mail at [email protected]. Should you wish to send your feedback on your interaction with the Game Master staff, please feel free to do so by e-mailing [email protected]. Creating multiple petitions and making multiple phone calls is completely unnecessary, and, if excessive, could eventually result in further account actions.
