Ninja looting, oops, I mean, scam question

After participating in a "discussions" in this forum, I do have a question about the way Blizzard addresses ninja looting/scamming when loot rules are involved.

Do the loot rules have to posted in raid chat for all in the raid to see to be considered "established"? What if I am replying to an LFM ad in trade, ask about loot rules in a whisper, and are given an answer?

Basically, do the loot rules of a particular raid group have to be posted in Raid chat, or is establishing loot rules with an individual player in a whisper enough to warrant a scam should the ML ninja an item.

If you were told that loot rules would be handled in such a way and then find that the agreement was not upheld (in any chat channel), please let us know so that we can investigate the issue and take all appropriate action.
