GM answer to LFD Loot Rules inside

I received an answer to this question I posed to a WoW in game GM:

Hello, could you please tell me if rolling Need on an item that is an upgrade to a spec I am not currently playing in an LFD dungeon is a bannable offence?

I am getting called a Ninja and being vote-kicked for rolling Need on these items.

I just want to make sure I am not doing anything I can get kicked from the game for.

The GM's answer was as follows (Screen Shot link included):

Hiko, if you have the option to roll need on an item, then you can use that item and have just as much right to roll on it as the next guy. You are not breaking any rules.

As this thread had a good solid 11 pages of posting in it prior to its arrival in the Customer Service forum though, I'm going to lock it up for now.
