Private Servers...??? - Blue Tracker

I was looking for add-ons and such and while i was, i found one website and it was talking about Private Servers being illegal. At school, my friend (he hacks, btw, but I dont know his account name :- /) says he has a Private Server. He claims its not illegal, he finds it on this one website, and its "obviously" from Blizzard, since hes paying $5/month tp blizzard@paypal or something.

Then i find all these people on YouTube advertising their WoW Private Servers and all. I'm a little confused here, are they legal or illegal? And if they are legal, where could I make one?
