Is naxxramas legal?

I was reading threw the terms of use of blizzard what were my rights etc,,,,, I have a lvl 60 char that is collecting pre tbc gear. but by modifiying they are disable the things I payed for.

"This software program, and any files that are delivered to you by Blizzard Entertainment, Inc. (via on-line transmission or otherwise) to "patch," update, or otherwise modify the software program, as well as any printed materials and any on-line or electronic documentation (the "Manual")"

Is this really modifying? In my eyes it's only disabling the opportunity for players which haven't tbc for playing wow. naxxramas have been removed. and soon onyxia to.
Ofcourse I agreed for wotlk terms of use, however I am wondering how far goes my right with nerfing my pre tbc account? I can't play when I accept the terms of use. are they going to refund my money when I don't accept?

Says I can, however it isn't after purchase but after a patch that was against my will installed and disabled the opportunity to go for end game raiding account on my 60 peep.

As I said blizzard isn't modifying, but disasbling, We payed for naxxramas and payed for onyxia, we diddn't knew that we had to pay a expansion to continue playing......
