Have Level 13 characters, no hardcore

I don't know if this is a feature or not, but I have some characters that are past level 10 from patch 13. But it won't let me create a hardcore character. Do I have to bring a new character to level 10 to unlock the hardcore?

You need to level a brand new character to level 10.
